Gentle Giants v Laird/Sayer, etal Lawsuit COURT DECISION IN
« on: February 22, 2006, 11:06:26 am »
Court decision has been made.

The Judge has dismissed ALL actions against ALL of us (Barbara Laird, Marc Sayer & Renee Broden) based on this case being a Meritless SLAPP Lawsuit because Gentle Giants / Burt Ward was unable to prove to the Judge that they could prevail IF this case went to trial.

As a reminder, the actions against us WERE as follows:

* Defamation (Libel) of Burt and Tracy
* Defamation (Trade Libel) of Gentle Giants Rescue and Adoptions Inc.
* Intentional Interference With Potential Economic Advantage of Gentle Giants Rescue and Adoptions Inc.
* Negligent Interference With Potential Economic Advantage of Gentle Giants Rescue and Adoptions Inc.
* Intentional Infliction of Emotional Distress of Burt and Tracy
* Negligence
* Injunctive Relief

It is now updated on my website:

In addition, the Press Enterprise has also published an article about the hearing:

I love it - I bet that's the first time Robin didn't want to see this and the Joker on the receiving end of it being himself:

SLAPP!

Actually ... it's the SECOND time that Boywonder has lost to a SLAPP suit.

Two years ago, Boywonder sued a newspaper for defamation ... and lost too.  He had to pay out over $40,000.00 in defense attorney fees.

This loss is going to cost him somewhere between $100K to $150K in defense attorney fees because he sued THREE people and lost to all three.

Imagine how that money could have benefitted the rescued dogs ... instead he is throwing it away to fivolous lawsuits.   I guess that's what makes his organization "Non-Profit"... all the profits are spent on legals fees, etc.

Sincerely,

You guys should team up with the people from last chance for animals. I just finished watching the dealing dogs documentary that showed how they were able to inflitrate and shut down a really horrible kennel

CORRECTION:
My "GUESS-TAMENT" for the legal fees were WAY OFF.  I have no idea how much the attorney fees are going to be.  I apologize for any panic that my previous post may have caused.

However, my point still stands ... what a waste of money

A quarter is 25,000 times too much to spend on lawyers when there are rescues who need to see a vet!  I'm so glad you guys won.

I drove past there once, several years ago, considering the idea.

The smell at the street convinced me not to make an an appointment.  It's probably the luckiest gut-jump decision I've ever made.

Congratulation s on your triumph over the Forces of Evil, Dane Woman.  You are TRULY one of the good guys.
